Lien waivers close the loop. Without one, a paid contractor can still file a lien and leave the lender exposed for more than the property is actually worth.

Interest Rate Limits and What Happens When Lenders Cross Them

Florida caps interest at eight percent on private loans, business purpose or not. Lenders who exceed that cap risk losing their right to collect interest altogether, and the state can add civil and criminal penalties on top of that loss. There is no workaround built into a private structure. The cap applies the same way it would to any institutional lender.

Title Insurance Still Matters

Skipping title insurance on a private loan can turn a first lien position into a third. Open notices of commencement and unresolved contractor liens can outrank a mortgage that looked clean at closing. A title search catches what a lender cannot see on their own, and that visibility is worth the cost every time.
